Senator Sheldon Whitehouse of Rhode Island is cautioning against blanket immunity for former Bush officials. He clearly believes enough malfeasance took place to suggest that preventing prosecutions that “could and would and should move forward” is “a big mistake.” Whitehouse appears to agree with Nancy Pelosi on this, but not so much Patrick Leahy.

Stimulus shmimulus. It’s all meaningless if the planet gets hit by an asteroid. And that almost happened Monday when a 200 foot wide rock called 2009 DD45 (much like the one above) zoomed by about 40,000 miles from earth. That’s just about twice as far away as many telecommunication satellites.
Experts are describing this as “a wafer-thin encounter” and is likely to return and be a future danger. And DD45 isn’t the only threat coming our way.

On Thursday, the California Supreme Court will hear arguments over Proposition 8, the state’s ban on same-sex marriage.
Gay-marriage opponents claim that if the Court strikes down the ban, it will “overturn the will of the people.” But as California Attorney General (and former Governor) Jerry Brown points out, courts have already ruled that discrimination cannot be imposed by the “will of the people”:

It’s not just some Democrats, as Republicans would have you believe, but Senate Republican Leader Mitch McConnell (right, with co-porker Thad Cochran) who has more than $75 million worth of earmarks in the omnibus bill. Some fine example he’s setting for those irresponsible, big-spending Democrats.
The earmarks McConnell asked for in the omnibus include $950,000 for the Western Kentucky University bikeway project, $427,000 for the Gunpowder Creek trail in Boone County and $1.6 million for the Forage Animal Production Research Laboratory in Lexington.
In total, McConnell has received 53 of the earmarks he requested, totaling $75.5 million, according to …

After referring to what Limbaugh does as “incendiary” and “ugly”, RNC Chair Michael Steele backed way off by apologizing to the talkmeister.
“My intent was not to go after Rush – I have enormous respect for Rush Limbaugh,” Steele said in a telephone interview. “I was maybe a little bit inarticulate. … There was no attempt on my part to diminish his voice or his leadership.”
Steele reached out to Limbaugh Monday afternoon after Limbaugh lambasted Steele on the radio.
Now, Steele tells Politico that Limbaugh is “a valuable conservative voice for our party.”

In an extraordinary move, on the heals of the revelation that the CIA destroyed almost 100 interrogation tapes, the Obama administration revealed anti-terror memos that show to what lengths the Bush administration went to claim additional powers after 9/11.
The Justice Department released nine legal opinions showing that, following the Sept. 11, 2001, terrorist attacks, the Bush administration determined that certain constitutional rights would not apply during the coming fight.
