Cops Called In NY-23 To Quell “Voter Intimidation”

November 3rd, 2009, 2:42 PM EST

Police were called to at least two polling places in St. Lawrence County because of “overzealous electioneering”.  June O’Nell, former Democratic state chairwoman reported this to the NY Daily News, calling it “voter intimidation.”

“We’ve gotten reports that people are standing there, covered with Hoffman stickers and yelling anti-choice stuff at voters,” said O’Neill, a St. Lawrence native who has been running the party’s GOTV effort for Bill Owens in NY-23.

“Apparently, there’s some woman claiming to be a commissioner,” O’Neill continued. “Commissioner of what, I don’t know. She’s from Texas, I think, and she won’t leave.”

“This is not the way we roll in the North Country.”

GOP Elections Commissioner Debbie Phaler had this comment:

“We had electioneering within the 100-foot polling marker,” Phaler said. “It’s my understanding that they were asked to leave and wouldn’t leave.”

“If people are electioneering within the marker and don’t stop when we ask them to, our inspectors are instructed to call law enforcement to assist them. I don’t think anybody was arrested.”

  1. You got pictures like the ones from last year with New Black Panther party vote intimidators?

GOTV, the group that uses felons?

    jasperjava Reply:

GOTV is not a group. It’s short for “Get Out The Vote”. Both parties have GOTV operations on election day, ranging from calling likely supporters to remind them to vote, or driving elderly or infirm people to the polling stations, stuff like that.

So there were a couple of tough-looking Black men loitering around one voting station in Philadelphia. That’s hardly large-scale voter intimidation. We know it makes you afraid, though…

You’re thinking of the GOP, obviously. That’s the people who have no respect for the constitution or the rule of law except as tools to further their political agenda. Because, like bush said, it’s only a piece of paper.

    jasperjava Reply:

A god-damned piece of paper, to be precise.

The only part of the Constitution that conservatives respect is the Second Amendment.

    You’re right.
    * Conservatives have little to show when asked to tell what they have done for expansion of liberty.
    * Conservatives, known as “Tories” came in second place during our Revolution, which we fought for liberty.
    * It was the liberals who fought to free the slaves.
    * Liberals were for giving women the vote.
    * Liberals gave us the Voting Rights Act.
    * Liberals gave us the Civil Rights Act.
    * When gays get equal rights, it will be because of the liberals.

That’s quite a lineup, but let’s be fair and maybe the conservatives around here will post a list of what THEY have done to expand the liberty enjoyed by Americans.

  2. The Black Panthers in Philadelphia were dressed in intimidating military style uniforms, and weilding night sticks, and they were intimidating those who went in to vote with threats. I guess that is ok because they were Obama supporters.

Voter intimidation is voter intimidation whether it is being done by supporters of the R candidate or the D candidate.

    Another 80% made up story;

I did a lot of research on this, and it is VERY strange.

    (a) Voluntary Dismissal.
    (1) By the Plaintiff.
    (A) Without a Court Order. Subject to Rules 23(e), 23.1(c), 23.2 and 66 and any applicable federal statute, the plaintiff may dismiss an action without a court order by filing:
    (i) a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment; or
(ii) a stipulation of dismissal signed by all parties who have appeared.
    (B) Effect. Unless the notice or stipulation states otherwise, the dismissal is without prejudice. But if the plaintiff previously dismissed any federal- or state-court action based on or including the same claim, a notice of dismissal operates as an adjudication on the merits.

First, they link you to the poll worker’s complaint from APRIL 7, 2009.

Then to the Civil Action Complaint filed with the US District Court….with NO date.

Finally to the Dismissal of 5/15 2009, which states:

    RULE 41(a)(1)(A) NOTICE OF DISMISSAL

“NOW COMES the Plaintiff, the United States, pursuant to Fed. R. Civ. P. 41(a)(1)(A)and files this Notice of Dismissal of the above action and states as follows”…It goes on and on

“RULE 41(a)(1)(A) NOTICE OF DISMISSAL” states:

“a notice of dismissal operates as an adjudication on the merits.” ..means that there was no substance OR too much time had elapsed.

There seems to be no evidence that warrants or subpoenas were ever issued.

It looks more like the what the Philly DA said, a “nonevent”.

The REAL problem is in “ELECTION FRAUD”….just ask David Iglesias.

So your point is that since the Black Panthers were given a pass that makes what they did just fine and dandy?

The federal government has an obligation to prosecute any and all who commit voter intimidation, including the Black Panthers.

    OldLefty Reply:

My point is, they were NOT given a pass, it did not meet the standards. we don’t know what they REALLY did or who the REALLY are.

The idea that they were “intimidating ” black, likely Obama voters from for Obama….is suspect itself.

Is your point that election fraud is just fine and dandy because the government and private voting machine companies did it?

    Daddio Reply:

What are you talking about Lefty? I never mentioned voter fraud in my comments. Are you fully awake this morning?

They know who these Black Panthers are Lefty. They were identified. We know what they did. They were videotaped while holding nightsticks and dressed in their military style uniforms. Witnessis told officials what they were saying to voters entering the precinct.

Don’t defend these people who are actually domestic style terrorists.

You mean like Bush and Cheney, who you’ve defended for eight years?

Or perhaps like the guy who was paid to carry and wear a heavy-duty gun to an event obama attended? with people like you out there, I’M thinking of joining the black panthers and i’m so white i’m nearly invisible.

    black panthers stand TALL!

Lefty, Daddio here was deprived as a child.
He was never taught, as so many of us were:

“Just because little Johnny down the street jumps off the roof, it doesn’t mean YOU have to go and jump off the roof.”

    It’s a classic conservative dodge.
When faced with something they can’t handle and which they have not been provided a reply by Limpbaugh or Manatee, they can be counted on to (A) Play shoot-the-messenger, or
    (B) Try to change the subject.

In this case it is (B), combined with an illogical attempt to justify one example of bad behavior with another example of bad behavior….

  3. Daddio, a leftover from yesterday that I did not see, regarding the Black Panthers:

Actually, those on the right saw bits of tapes that were meaningless, and then spun for a nice little right wing tale of bogey men.

One witness, Jacqueline Dischell confirms that there were in fact two black panthers guarding the polling place, a nursing home on Fairmont Avenue in north Philadelphia, earlier this morning.

But she says one was an officially designated poll watcher (it was not immediately clear which municipal office had designated him in that role), and the second was his friend. The second panther, who left two or three hours ago, was the one with the nightstick, she says.

Dischell says that earlier this morning a few men who identified themselves as being from the McCain campaign came and started taking pictures of the two panthers on their cell phones. She suggested that they seemed to be baiting the panthers, and that the designated watcher may have given one of them the finger in response to the picture taking.

The police came roughly an hour and a half later. She says she talked to the cops and told them there had been no incident. The police drove away without getting out of the car, she adds.

Some time later, a second, larger group of men whose affiliation couldn’t be determined came with real cameras and started taking more pictures. Maybe 15 minutes later the cops returned. This time, they spoke to people on both sides, and told the panther not designated to watch the polls to leave, which he did without an argument.

the Philadelphia District Attorney’s office, says the office is not investigating the matter, calling it a “non-incident.” Abookire says, “We have had no complaints from any voters that they have been intimidated.”

I think this another example of the right taking a grain of truth, then spining into something completely different.

But I know that the right LOVES this stuff.
