At first, it seemed as though David Prosser would coast to reelection as a Wisconsin Supreme Court justice were it not for the ham-handed Republicans, led by Governor Scott Walker, looking to destroy public unions.

The contest between incumbent David Prosser and liberal challenger JoAnne Kloppenburg has attracted an infusion of outside spending that could total as much as $5 million. Much of it has been expended on increasingly ugly ads funded by independent groups that either have a stake in the Wisconsin union fight or see the outcome of the court race as a potentially symbolic pivot point on an issue with major implications for the 2012 election.

The court currently has four conservatives and two liberals and, although this is supposedly a non-partisan race that wouldn’t tip the court, it can have a profound effect in predicting which way the wind is blowing and show that the labor movement has been awakened.

The Tea Party Express warned in a Sunday fundraising email that “If radical liberal Joanne Kloppenburg wins, then Barack Obama and his union thug allies will have won.” On the other hand, it asserted “If conservative Justice David Prosser wins, then Gov. Scott Walker and the tea party movement will have won in Wisconsin. The stakes could not be higher.”

Prosser recently called Wisconsin’s Chief Justice Shirley Abrahamson a “total bitch” and then claimed it was “entirely warranted.”
