Submitted by Obwon
A decision by the New York State Supreme Court upholds the move by New York City to clear tents from Zuccotti Park and stop them from bringing more equipment in.
CBS News legal analyst Andrew Cohen reports that the key paragraph in the judge’s ruling is as follows: “Here, movants have not demonstrated that the rules adopted by the owners of the property, concededly after the demonstrations began, are not reasonable time, place, and manner restrictions permitted under the First Amendment.”
“Time, place and manner” restrictions on speech like the demonstrators had petitioned against have a long …

Antonin Scalia and Clarence Thomas were featured guests at a dinner sponsored by those who have business before the court.
The lawyer who will stand before the court and argue that the law should be thrown out is likely to be Paul Clement, who served as U.S. solicitor general during the George W. Bush administration.
Clement’s law firm, Bancroft PLLC, was one of almost two dozen firms that helped sponsor the annual dinner of the Federalist Society, a longstanding group dedicated to advocating conservative legal principles. Another firm that sponsored the dinner, Jones Day, represents one of the trade …

Newt Gingrich was hired to promote the public/private structure of Freddie Mac to stop the conservative effort to dismantle the agencies.
Gingrich’s role as a consultant for Freddie Mac was raised in the debate as Republicans, including House Financial Services Committee Vice Chairman Jeb Hensarling, a Texas Republican, are criticizing the $181 billion in taxpayer funds the company and its sister firm, Fannie Mae, have received since they were seized by the U.S. government in September 2008.
Gingrich has been critical of the Fannie/Freddie business model, and says he told them their business model was unrealistic.
“I offered them advice …

The Supreme Court denied to stay executions in Ohio and Florida.
The court denied appeals from Reginald Brooks, who is scheduled to be executed for fatally shooting his three sons while they slept. It also rejected appeals from Oba Chandler, scheduled to die for killing an Ohio woman and her two teen daughters.
State and U.S. courts have rejected attorneys’ arguments that the 66-year-old Brooks is not mentally competent and that the government withheld relevant evidence that could have affected Brooks’ case. Lawyers for the 65-year-old Chandler say his right were violated at his trial.…

Rick Perry would cut members’ pay and office budgets in half.
Mr. Perry also said he would end lifetime federal appointments to the bench — capping the term of service at 18 years for Supreme Court justices. He also vowed to end bailouts of banks and funding for Planned Parenthood, the nation’s leading provider of abortions. Tax increases, he said, should require a two-thirds majority vote in Congress, while the salaries of federal workforce — except military and law-enforcement employees — should be frozen.…

Perhaps what might come out of Occupy Wall Street will be a change in the way we elect our politicians. Russell Simmons is calling for a constitutional amendment that would take all but public money out of elections.
Section 1. All elections for President and members of the United States House of Representatives and the United States Senate shall be publicly financed. No political contributions shall be permitted to any federal candidate, from any other source, including the candidate. No political expenditures shall be permitted in support of any federal candidate, or in opposition to any federal candidate, from any …

The National Lawyers Guild obtained a court order allowing protesters back at Zuccotti Park.
The guild said the injunction prevents the city from enforcing park rules on Occupy Wall Street protesters.
At a morning news conference at City Hall, Mayor Michael Bloomberg said the city knew about the court order but had not seen it and would go to court to fight it. He said the city wants to protect people’s rights, but if a choice must be made, it will protect public safety.…

Dozens of protesters were arrested and hundreds ousted by police in an effort to clear Zuccotti Park where the Occupy Wall Street movement began.
Early Tuesday, Mayor Michael R. Bloomberg issued a statement explaining the reasoning behind the action. He spoke about the need to balance the right of free speech with public safety and health concerns…
Mr. Bloomberg stressed that the protesters would still be able to use the park, as long as they complied with the rules, that ban things such as tents and sleeping bags.
“Protestors have had two months to occupy the park with tents and …

Attorney Joe Amendola says that just because you shower with children, it doesn’t mean you’re automatically a pedophile.
“Jerry Sandusky is a big, overgrown kid. He’s a jock,” Amendola told CNN’s Anderson Cooper. “The bottom line is jocks do that — they kid around, they horse around.”…
